The Future of International Law: Transnational and Global Perspectives

Module 718M3

Module details for 2022/23.

30 credits

FHEQ Level 7 (Masters)

Module Outline

We live in a highly interdependent and increasingly multi-polar world in which states, corporations, international organizations and transnational networks all seek to achieve competing political and economic aims. The challenges posed by environmental harm, mass migration, outer-space and conflicts over territorial boundaries are challenging the role and very structure of international law. Students will examine how transnational and global perspectives attempt to address contemporary global challenges in areas beyond the jurisdiction of state(s), such as the oceans, outer space, cross-border and extraterritorial activities, and what proposals exist for transforming international law in response to these challenges.

Module learning outcomes

Demonstrate knowledge of transnational and global perspectives towards contemporary global challenges that occur outside the traditional conception of the state, such as in outer space, within our oceans, cross-border and extraterritorial activities.

Demonstrate critical awareness of the relevant contexts for such transnational and global challenges through contemporary interdisciplinary perspectives.

Demonstrate knowledge of both the doctrinal and interdisciplinary academic literature on the contemporary legal regimes.

Reflect critically on how the field of international law may be transformed in order to address such ‘transnational’ and ‘global’ activities.
