Module Outline
This module introduces students to the historical relationship between Equity and areas of common law as well as Equity’s continuing relevance. The focus of the module is on the use of trusts as a mechanism for holding property, including the formation and constitution of various types of express and implied trusts. Students apply the rules and principles derived from the case law and statutory provisions to hypothetical scenarios as well as evaluate the use of trusts as a mechanism for holding property. The module also considers the powers and duties of trustees in relation to trust property. Students will be encouraged to reflect on the role of legal principles and judicial discretion in the evolution of equitable doctrines and how these interact with underlying notions of fairness.
Module learning outcomes
Demonstrate critical awareness of the constituent components of a range of valid and enforceable trusts as well as the nature of trustees’ duties and powers.
Deploy originality in the application of the rules and principles of Equity derived from case law and statutes to hypothetical problem scenarios.
Display self-direction in the development and analysis of legal arguments in relation to the use of trusts and the ongoing relevance of equitable principles.
Devise and reflect upon ways of communicating complex legal arguments orally and in writing when addressing both factual scenarios involving trusts and discursive questions about Equity generally.
