Module Outline
Equity & Trusts 2 will look at both express and implied trusts in contemporary settings. Specifically, students will study resulting trusts, common intention constructive trusts of a shared home, private purpose trusts and public purpose trusts (charities).
Pre-Requisite
Equity & Trusts 1 is a prerequisite.
Module learning outcomes
Exhibit understanding of how equitable principles work to construct/imply a trust.
Evidence a critical understanding of statutory and common law rules, their context, their application and any need for reform
Employ relevant legal principles in the interpretation and solving of factual and hypothetical problem scenarios
Use appropriate primary and secondary sources in the critical analysis/evaluation of the law.
