Module 712M3

Module details for 2024/25.

15 credits

FHEQ Level 7 (Masters)

Module Outline

Advanced Legal Research and Writing serves two functions: (1) to ground students in the conventions of advanced academic writing in law, which is a rather specialised form of discourse with many non-obvious conventions and norms; and (2) to ground students in the leading traditions or approaches in academic legal research. The module will cover modern standards for the citation of legal authorities (such as OSCOLA), as well as the justification for them. Legal traditions covered will include (1) doctrinal exposition and analysis (2) critique of doctrine, institutional design and practice; and (3) researching the dynamics of law.

Module learning outcomes

Demonstrate critical awareness of professional norms relating to integrity and transparency in academic legal writing and research, and their application to different legal writing and research ...techniques.

Demonstrate ability to deploy the conventions of one particular standard for the citation of legal authorities in a way that not only demonstrates mastery of the relevant standards, but is also consistent with underlying values of honesty and integrity in academic writing.

Demonstrate systematic understanding of the distinctive features of some of the main traditions of academic legal research, critical awareness of the power and limitations of these different approaches, and to locate different approaches to research within (or across) these traditions.
